These General Terms and Conditions govern the booking and participation in the experiences offered by LOFOEX SL, Tax ID B70913058, with registered address at Paseo de las Delicias, 1, 41001, Seville, Spain, and contact email info@localfoodexperiences.com, operating under the commercial brands Local Food Experiences, Gracias Gastro, and any other trademarks owned by the company.
By making a reservation, customers expressly accept these Terms and Conditions in full.
1. Purpose and Scope
These Terms regulate the booking, purchase, and participation in gastronomic, cultural, and tourism experiences organized by LOFOEX SL.
LOFOEX SL provides experiential and gastronomic tourism services and does not operate as a traditional restaurant or bar open to the general public. Only the products, drinks, menus, and services expressly included in each experience shall be provided.
These Terms also apply to bookings made through travel agencies, tour operators, online platforms, or business partners, without prejudice to any specific agreements that may exist with such entities.
2. Prices and Taxes
All prices are displayed in euros (€) and include applicable VAT unless otherwise expressly stated.
Bank charges, payment gateway fees, and transaction costs associated with specific payment methods shall be borne by the customer whenever applicable.
3. Right of Withdrawal
In accordance with applicable legislation, the statutory fourteen (14) day right of withdrawal does not apply to leisure, tourism, gastronomic, or cultural services provided on a specific date or within a specific period.
By confirming a reservation, customers expressly acknowledge and accept this legal exception.
4. Reservations and Payment Methods
Public experiences may be paid through credit or debit card, bank transfer, Bizum, or any other payment methods enabled by the company.
Private bookings must be paid by bank transfer as follows:
- 50% of the total amount upon confirmation of the reservation.
- The remaining 50% no later than thirty (30) days before the event.
If the booking is made within thirty (30) days prior to the event, full payment shall be required at the time of confirmation.
A private booking is defined as any experience reserved exclusively for one customer or group, regardless of the number of participants.
5. Cancellation Policy
5.1 Public Experiences
Cancellations made more than twenty-four (24) hours before the scheduled starting time shall receive a full refund.
Cancellations made within twenty-four (24) hours of the experience shall not be eligible for any refund.
Transaction fees and payment processing costs borne by the customer shall not be refunded in cases of voluntary cancellation.
5.2 Private Experiences
Private reservations shall be subject to the following conditions:
- Thirty (30) days or more before the event: 100% refund.
- Between fifteen (15) and twenty-nine (29) days before the event: 50% refund.
- Within fifteen (15) days of the event: no refund.
6. Changes to Date, Time, or Activity
All modifications requested by customers shall be subject to availability and express approval by LOFOEX SL.
Any change of date, time, or activity shall incur a fee of €10 per person.
If the new activity is more expensive, the customer must pay the corresponding price difference.
If the replacement activity is cheaper, the difference shall be refunded after deducting the applicable change fee.
Customers shall be informed of these conditions through any of the available communication channels when requesting a modification.
7. Punctuality and No-Shows
Participants are required to arrive ten (10) to fifteen (15) minutes before the scheduled starting time.
All customers receive a confirmation email clearly stating the timetable and punctuality requirements.
Experiences shall begin at the scheduled time with the participants who have arrived.
Customers arriving more than five (5) minutes after the official start time shall be considered no-shows.
Late arrivals and no-shows are not entitled to refunds or compensation.
Customers who voluntarily leave an experience after it has begun shall likewise not be entitled to any refund.
8. Additional Participants and Ticket Transfers
Additional participants may only be accepted subject to operational availability and may incur special last-minute booking fees.
LOFOEX SL reserves the right to deny access to additional guests if participation is not feasible.
Participant substitutions are permitted provided that the replacement corresponds to the same ticket category originally booked.
9. Minors
Children are welcome to participate in all activities under the sole responsibility of their parents or legal guardians.
All minors must remain accompanied by a responsible adult throughout the entire experience.
The consumption of alcoholic beverages by individuals under eighteen (18) years of age is strictly prohibited.
Staff may request proof of age whenever there is reasonable doubt regarding a participant’s eligibility to consume alcohol.
10. Allergies, Dietary Restrictions, and Special Needs
All allergies, intolerances, dietary restrictions, mobility requirements, advanced pregnancies, or special circumstances must be communicated at least twenty-four (24) hours before the activity.
LOFOEX SL reserves the right to reject or cancel bookings that cannot be safely or reasonably accommodated.
Where food and beverages are prepared, handled, or served by independent third-party establishments, LOFOEX SL shall not be liable for incidents arising exclusively from such external providers, without prejudice to their own legal responsibilities.
Failure to provide prior notice may result in the inability to participate without entitlement to a refund.
11. Pets, Luggage, and Personal Belongings
Pets are permitted only when allowed by the nature of the activity and by any collaborating venues involved.
Customers must notify the company in advance if they intend to bring animals.
Storage or safekeeping of luggage, strollers, or bulky items cannot be guaranteed unless previously arranged.
Participants remain solely responsible for their personal belongings except in cases of proven negligence by LOFOEX SL.
12. General Rules of Conduct
Participants must behave respectfully towards staff, fellow guests, and collaborating establishments.
The following are strictly prohibited:
- Smoking or vaping during any activity.
- Bringing outside food or beverages.
- Wearing costumes, accessories, or clothing associated with bachelor or bachelorette parties.
- Recording entire explanations, tastings, demonstrations, or educational content.
- Disrupting the normal development of the experience.
LOFOEX SL reserves the right to refuse admission or immediately remove any participant who:
- Is under the influence of alcohol or drugs.
- Displays aggressive or disrespectful behavior.
- Endangers the safety of others.
- Fails to follow staff instructions.
Removal from the activity shall not entitle the participant to any refund and may involve law enforcement authorities where necessary.
Participants shall be financially responsible for any damages caused to facilities, materials, or collaborating establishments.
13. Large Group Policies
Additional organizational measures may apply to large groups, including:
- Separation into multiple tables or areas.
- Restrictions on moving furniture.
- Mandatory silence during explanations and tastings.
- Delayed access for late arrivals until appropriate moments within the activity.
Failure to comply may result in immediate removal without refund.
14. Languages
Public experiences are generally conducted in English.
Private experiences may be conducted in other languages when expressly requested, contracted, and operationally available.
15. Operational Changes
LOFOEX SL reserves the right to introduce reasonable modifications that do not substantially alter the nature of the experience, including:
- Substituting wines, tapas, or products with equivalent alternatives.
- Replacing guides, chefs, hosts, or instructors.
- Adjusting routes due to public works, events, or logistical needs.
- Changing collaborating venues when necessary.
The duration of experiences is approximate and may vary due to operational or weather-related circumstances.
16. Cooking Workshops and Food Handling
For experiences involving food preparation or direct handling of cooking equipment, participants must strictly follow staff instructions.
Any damages resulting from negligent or improper use shall be the sole responsibility of the participant.
17. Company Cancellations and Force Majeure
LOFOEX SL may cancel, modify, or reschedule activities due to justified circumstances, including but not limited to:
- Adverse weather conditions.
- Illness of essential staff members.
- Technical failures.
- Administrative or police restrictions.
- Public works.
- Religious processions or local events.
- Traffic disruptions.
- Pandemics, strikes, or public emergencies.
- Unexpected closures of collaborating establishments.
The company shall endeavor to offer an alternative date or equivalent activity.
Should the customer decline the proposed alternatives, a full refund shall be issued, including any transaction costs assumed by the company.
18. Photography and Audiovisual Material
Participants may take photographs and videos for personal use only.
The full recording, commercial exploitation, or unauthorized distribution of explanations, workshops, or educational content is strictly prohibited.
LOFOEX SL may capture photographs or videos for promotional purposes while respecting any participant who expressly requests not to appear.
19. Intellectual Property
All materials, explanations, designs, trademarks, photographs, and related content remain the property of LOFOEX SL or their respective owners.
Any unauthorized reproduction, distribution, or commercial use is prohibited.
20. Amendments to These Terms
LOFOEX SL reserves the right to modify or update these Terms and Conditions at any time.
The version in force on the date of booking shall apply to the relevant reservation.
21. Amicable Resolution of Disputes
Before initiating legal proceedings, both parties shall attempt to resolve any disagreement through good-faith communication and negotiation.
22. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by Spanish law.
Without prejudice to the mandatory rights granted to consumers under applicable legislation, any disputes arising from these Terms shall fall under the jurisdiction of the courts of Seville, Spain.
In the event of any discrepancy or inconsistency between the Spanish and English versions of these Terms and Conditions, the Spanish version shall prevail.
